Under Wisconsin Law, there are four types of restraining orders which may be issued for the protection of an individual or a child. They are domestic abuse, harassment, child abuse, and individual at-risk orders. The injunction can last for a period of up to four years and in special instances ten years. The injuncted may be prohibited from possessing a firearm throughout the period of the injunction. Failure to comply with the terms of the injunction may results in criminal charges. The restraining order and injunction process oftentimes requires the assistance of an experienced attorney. Restraining orders and injunctions are a two-part process in the State of Wisconsin. First, the petitioner must request a temporary restraining order from the court. The Petitioner will file a petitioner and the judge will review and make a determination right then and there and without the other party present. If the restraining order is granted, the temporary restraining order will be in effect for 14 days. The petitioner must have the Sheriff serve the temporary restraining order on the other party. Second, the court will hold a hearing within 14 days to determine whether to issue an injunction, which is the final relief. An injunction can last for a period of up to four years and in special instances ten years.
Domestic Abuse Restraining Orders and Injunctions: defined as the intentional inflection of physical pain, physical injury, or illness, intentional impairment of physical condition, sexual assault, stalking, damage to property, or a threat to do any of the above by an adult family member or adult household member against another adult family member or adult household member, by an adult caregiver against an adult who is under the caregiver’s care, by an adult against his or her adult former spouse, by and adult against an adult with whom the individual has a dating relationship, or by an adult against an adult with whom they have a child in common.
Harassment Restraining Order: defined as striking, shoving, kicking or otherwise subjecting another person to physical contact; engaging in an act that would constitute abuse, sexual assault, or stalking, or attempting to do the same; or engaging in a course of conduct or repeatedly committing acts which harass or intimidate another person and which serve no legitimate purpose.
Child Abuse Restraining Order: defined as physical injury inflicted on a child by means other than accident; sexual intercourse or contact with a child; exploitation of a child; manufacturing controlled substances in the presence of a child; and/or encouraging prostitution of a child.
Individual at Risk Order: protects abuse against elderly people and younger vulnerable adults.
